Excerpt from Report of Evidence Taken Before the Royal Commission Appointed to Inquire Into the Value of the Central Prison Labour

The Commissioners appointed to consider questions in dispute between the Canada Car Company and the Government of the Province of Ontario, respecting the value of prison labour furnished to the Company by the Government, met at Ten o'clock, a. m., on Wednesday, June 20th, in the Parliamentary Buildings, Toronto. The Commissioners were the Hon. W. P. Howland, Z. R. Brockway, Esq., and James Noxon, Esq.

Hon. W. P. Howland, was, on motion, unanimously chosen Chairman of the Commission. Messrs. Richardson, Bradley and Lumsden were appointed Secretaries and Short-hand writers.

Hon. Mr. Hardy appeared on behalf of the Government. Hon. Mr. Wells represented the Company. Mr. Langmuir, Inspector of Prisons, was in attendance.

The Commission, authorizing the enquiry, was read, as follows: -

To the Honourable William Pearce Howland, of the City of Toronto, Z. R. Brockway, Superintendent of the Adult Reformatory, Elmira, State of New York, and James Noxon, of the Town of Ingersoll, Ontario, Esquire, our Commissioners in this behalf.


Whereas, in and by a Statute of the Province passed in the thirty-first year of our reign, entitled, "An Act to repeal Chapter B. of the Consolidated Statutes of Canada, so far as the same relates to Ontario, to authorize the publication, in the Ontario Gazette, and to make provision for inquiries concerning public matters and official notices," it is enacted, that whenever the Lieutenant-Governor in Council deems it expedient to cause inquiry to be made into and concerning any matter connected with the good government of this Province, or the conduct of any part of the public business thereof, or the administration of Justice therein, and such enquiry is not regulated by any special law, the Lieutenant-Governor may, by the Commission in the case, confer upon the Commissioners or persons by whom such enquiry is to be conducted, the power of summoning before them any party or witness, and of requiring them to give evidence on oath, orally or in writing (or on solemn affirmation if they be parties entitled to affirm in civil matters), and to produce such documents and things as such Commissioners deem requisite to the full investigation of the matters into which they are appointed to examine, and that the Commissioner or Commissioners shall then have the same power to enforce the attendance of such witnesses and to compel them to give evidence, as is vested in any Court of Law in civil cases.
